Judge Howard Whitehead has denied a defense request to have Philip Chism be tried as a minor for the rape and murder of his Danvers High School math teacher Colleen Ritzer. Philip Chism was 14 at the time of the murder. Defense attorney Denise Regan unsuccessfully argued on Tuesday of this week that Massachusetts law requiring minors 14 and over that are charged with murder to be tried as adults was “unconstitutional”. Judge Whitehead agreed with Essex County Assistant District Attorney Kate MacDougall who said Chism is accused of a “heinous” crime and is “amply protected” by current law requiring he be tried as an adult.
